Terms and Conditions

GTW Gear Online Store Terms and Conditions

This English version is provided for customers using the en_US version of the Store. The Store is operated under Polish law.

Chapter 1. General provisions and contact details

  1. These Terms and Conditions (the “Terms”) govern the use of the GTW Gear online store available at https://gtwgear.com (the “Store”).
  2. The Store is owned by Krzysztof Gluch, trading as EMKA-GTW Krzysztof Gluch, with its registered address at Gajków, ul. Młyńska 13, 55-002, Poland, entered in the Polish Central Register and Information on Economic Activity, Tax ID (NIP): 9121004361, National Business Registry Number (REGON): 932369560 (the “Seller”).

Customer-service telephone hours are stated on the Contact page. The contact point for communications with authorities of EU Member States, the European Commission, and the European Board for Digital Services is info@gtwgear.com. Such communications may be conducted in Polish.

Chapter 2. Technical requirements

  1. Use of the Store requires a computer or other device with a web browser, Internet access, and an active email address.

Chapter 3. Personal data

  1. The Seller is the controller of the personal data of Store customers.
  2. Information on the processing of customer data and the data of other Store users is provided in the Privacy Policy.

Chapter 4. Conclusion of a sales contract and customer account

  1. The Store enables customers to purchase goods displayed on its website (the “Goods”) either without registering or by creating a Store account. To place an order, the customer selects Goods, adds them to the cart, and completes the checkout by choosing the available delivery and payment options.
  2. Product information, descriptions, and prices displayed in the Store constitute an invitation to enter into a contract within the meaning of Article 71 of the Polish Civil Code and are subject to these Terms.
  3. An order may be placed after all information required to perform the contract has been provided. At the customer's request, the information required to issue a VAT invoice must also be supplied.
  4. Registration of a customer account (the “Account”) is completed once. The customer's email address and chosen password are subsequently used to sign in. The detailed rules for the Account service are set out in the Account Terms below. Where available, the Store may also permit sign-in through social media or a Google account. After signing in, the customer can view order history and reuse saved details during subsequent purchases.
  5. The customer may close the Account at any time and without charge by sending a request to info@gtwgear.com.
  6. By confirming an order using the “Order and pay” button or another button with equivalent wording, the customer submits an offer to purchase the selected Goods under these Terms and accepts the obligation to pay the price of the Goods and the applicable delivery charges.
  7. The sales contract (the “Contract”) is concluded when the Seller accepts the order for processing. The Seller confirms acceptance by email.
  8. If an order cannot be fulfilled in whole or in part, the Seller will inform the customer and no Contract will be concluded for the unavailable part. The Seller may propose partial fulfillment or waiting for stock to be replenished. Any payment made for an order or part of an order that cannot be fulfilled will be refunded without undue delay.
  9. The Seller will provide confirmation of the Contract on a durable medium no later than upon delivery of the Goods.
  10. The Store is not liable for non-delivery or delay caused by an incomplete or incorrect delivery address or by the customer's failure to provide other information necessary to fulfill the order.
  11. The Seller may suspend order processing if the customer supplies false information or if there are reasonable grounds to doubt its accuracy. Where possible, the Seller will contact the customer to verify the information.

Chapter 5. Prices and payment methods

  1. Prices are shown in Polish zloty (PLN) and include VAT. The en_US storefront may additionally display converted prices in another supported currency.
  2. Delivery charges are shown separately in the cart and depend on the delivery method selected.
  3. Available payment methods are described on the Payment Methods page and presented during checkout. They may include bank transfer, instant electronic transfer, BLIK, supported digital wallets through Shoper Payments (Autopay), PayPal or Przelewy24, Visa or Mastercard payment cards, cash on delivery, and cash or card payment upon collection where this option is offered.
  4. If ordinary bank transfer is selected, payment must be made within two days after the order is placed. If payment is not received within that period, the Contract is deemed not to have been concluded. This does not apply where the Seller offers deferred payment or installments through an external partner.
  5. For Shoper Payments, online instant-transfer and card-payment services are provided by Autopay S.A.

Chapter 6. Delivery

  1. Depending on availability and destination, delivery may be made by courier, to an InPost parcel locker, or by personal collection.
  2. Personal collection is available at ul. Oławska 16A, 55-020 Stary Śleszów, Poland, when offered during checkout.
  3. Except for personal collection, an order is considered dispatched when the parcel is handed to the carrier. The carrier determines the actual delivery date.
  4. The Seller normally dispatches Goods within two business days unless a different lead time is clearly stated on the product page. Detailed lead-time information is available on the Order Processing Time page.
  5. The Seller routinely processes orders for delivery within Poland at the rates shown on the Shipping Times and Costs page. International shipping is available at the rates shown in the Store or individually agreed with the customer.

Chapter 7. Right of withdrawal

  1. A customer who is a consumer or a natural person conducting business to whom consumer rights apply under Article 7aa of the Polish Consumer Rights Act (a “Privileged Entrepreneur”) has the statutory right to withdraw from a Contract for Goods within 14 days after receiving them, without giving a reason, subject to the exceptions below.
  2. To meet the deadline, the customer must send a withdrawal statement within the 14-day period by email to info@gtwgear.com or in writing to Gajków, ul. Młyńska 13, 55-002, Poland.
  3. The customer may use the model withdrawal form available at this link, but its use is optional. The Seller will promptly confirm receipt by email.
  4. The customer must return the Goods at their own expense within a further 14 days to ul. Oławska 16A, 55-020 Stary Śleszów, Poland.
  5. No later than 14 days after receiving the withdrawal statement, the Seller will refund the price of the Goods and the cost of the least expensive standard delivery method offered by the Store. The Seller may withhold the refund until the Goods are received or the customer provides evidence that they have been sent back.
  6. The refund will be made using the original payment method unless the customer expressly agrees otherwise.
  7. The customer is liable for any reduction in value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the Goods.

Chapter 8. Exceptions to the right of withdrawal

  1. The right of withdrawal does not apply in the cases provided by law, including contracts for: non-prefabricated or personalized Goods made to the consumer's or Privileged Entrepreneur's specifications; perishable Goods; sealed Goods which, after opening, cannot be returned for health-protection or hygiene reasons; sealed audio or video recordings or computer software after opening; Goods which by their nature become inseparably mixed with other items after delivery; newspapers, periodicals, or magazines other than subscriptions; Goods whose price depends on financial-market fluctuations outside the Seller's control; and alcoholic beverages whose price was agreed at the time of the Contract but which can be delivered only after 30 days and whose value depends on market fluctuations outside the Seller's control.

Chapter 9. Complaints and conformity

  1. The Seller must deliver Goods that conform to the Contract.
  2. For consumers and Privileged Entrepreneurs, the Seller is liable for conformity under the Polish Consumer Rights Act. For other customers, liability is governed by the Polish Civil Code.
  3. Complaints may be submitted by email to info@gtwgear.com or in writing to ul. Oławska 16A, 55-020 Stary Śleszów, Poland.
  4. The Seller will respond using the same medium in which the complaint was made within 14 days after receipt.
  5. A consumer or Privileged Entrepreneur who is dissatisfied with the outcome may use available out-of-court complaint and redress procedures in addition to proceedings before an ordinary court. Assistance may be requested from the relevant Trade Inspection authority, a district or municipal consumer ombudsman, a qualified consumer organization, or a permanent consumer arbitration court. Additional information is available from the Polish Office of Competition and Consumer Protection at polubowne.uokik.gov.pl.

Chapter 10. Product reviews and illegal content

  1. Signed-in Account holders may submit product reviews (“Reviews”). Reviews must comply with these Terms, the EU Digital Services Act (“DSA”), applicable law, and generally accepted standards of conduct.
  2. Reviews must not be unlawful, offensive, pornographic, hateful, discriminatory, infringe copyright, privacy, or other third-party rights, or contain commercial or advertising content relating to products not offered by the Store.
  3. The Seller and/or the provider of an external customer-review service may moderate Reviews. A Review that violates these Terms may be withheld or removed.
  4. If a Review is restricted or removed, the Seller will inform the customer and provide reasons. The customer may appeal by email to info@gtwgear.com or in writing to ul. Oławska 16A, 55-020 Stary Śleszów, Poland. The Seller will acknowledge an electronic appeal and respond within 14 days.
  5. Any Store visitor may notify the Seller at info@gtwgear.com of content they consider illegal under the DSA or contrary to these Terms. The Seller will acknowledge the notice electronically and decide it within 14 days, giving reasons. The person who submitted the notice may appeal using the procedure above and may use DSA out-of-court dispute-settlement mechanisms.
  6. The Seller is not liable for customer Reviews where it has no knowledge of illegal content and acts promptly to remove or disable access after obtaining such knowledge, including by promptly considering notices.

Chapter 11. Final provisions

  1. Contracts concluded through the Store are governed by Polish law. Nothing in these Terms excludes or limits mandatory consumer rights.
  2. The Seller may amend these Terms. Amendments apply to orders placed after the new version is published. Customers with previously concluded ongoing digital/electronic-service contracts and customers who hold an Account will be notified and informed of their right not to accept the amended wording.
  3. These Terms are effective from July 25, 2025.

GTW Gear Account Terms

1. General provisions

  1. These Account Terms govern the free customer-account service provided in the GTW Gear Store. They constitute terms for an electronic service under Polish law and supplement the Store Terms above.
  2. The Seller's Account-service contact details are: Gajków, ul. Młyńska 13, 55-002, Poland; info@gtwgear.com; +48 607 500 320.

2. Technical requirements and features

  1. The technical requirements are the same as those stated in Chapter 2 of the Store Terms.
  2. The Account enables the customer to save personal and delivery information for future purchases, view order history, and check order status.

3. Contract, withdrawal, and closure

  1. Creating an Account concludes an electronic-service contract for an indefinite period. The customer may close the Account at any time and without giving a reason by contacting info@gtwgear.com. The customer also has a statutory 14-day right to withdraw from the Account-service contract.

4. Complaints

  1. For consumers and Privileged Entrepreneurs, conformity of the Account service is governed by the Polish Consumer Rights Act; for other customers, the Polish Civil Code applies.
  2. Complaints and out-of-court remedies follow the procedures in Chapter 9 of the Store Terms.

5. Personal data

  1. Information on processing personal data for the Account service is provided in the Privacy Policy.

6. Changes

  1. The Seller may amend the Account Terms under Chapter 11 of the Store Terms. A customer who does not accept the amended wording may terminate the Account-service contract by contacting the Seller electronically, subject to a 14-day notice period.

GTW Gear Newsletter Terms

1. General provisions

  1. These Newsletter Terms govern the free newsletter service provided by the Seller to a person who has given the required marketing consent (the “Subscriber”). They constitute terms for an electronic service under Polish law and supplement the Store Terms above.
  2. The Newsletter may contain commercial information about the Store and Seller, industry-related content, and educational material considered useful to customers or prospective customers.

2. Technical requirements and service

  1. Use requires a device and software capable of receiving email, an active email address, and Internet access.
  2. The Newsletter may include information about new products and promotions, discount codes and subscriber benefits, and other Store-, Seller-, industry-, or education-related content.
  3. The Seller does not guarantee a particular sending frequency and determines the timing and content of each Newsletter.

3. Subscription, withdrawal, and cancellation

  1. A Newsletter contract may be concluded by submitting the Store's subscription form or by selecting the relevant consent checkbox during checkout.
  2. The Seller may offer a subscription bonus such as a discount code, digital content, or a delivery benefit. The applicable offer will be described in the Store and delivered electronically to the subscribed email address without undue delay.
  3. The Newsletter contract is concluded for an indefinite period. The Subscriber may cancel at any time and without giving a reason by using the unsubscribe link included in each Newsletter or by contacting the Seller electronically.
  4. The Subscriber has a statutory 14-day right to withdraw from the Newsletter-service contract.
  5. The Seller may discontinue the Newsletter after informing Subscribers. If a Subscriber does not open Newsletter messages for more than two years, the Seller may discontinue the service for that Subscriber after giving additional advance notice.

4. Complaints

  1. For consumers and Privileged Entrepreneurs, conformity of the Newsletter service is governed by the Polish Consumer Rights Act; for other customers, the Polish Civil Code applies.
  2. Complaints and out-of-court remedies follow the procedures in Chapter 9 of the Store Terms.

5. Personal data

  1. Information on processing personal data for the Newsletter is provided in the Privacy Policy.

6. Changes

  1. The Seller may amend the Newsletter Terms under Chapter 11 of the Store Terms. A Subscriber who does not accept the amended wording may terminate the Newsletter contract with 14 days' notice by contacting the Seller electronically or with immediate effect by using the unsubscribe method described above.
